2026 Supreme(MP) 367

IN THE HIGH COURT OF MADHYA PRADESH AT GWA LIOR
ANAND SINGH BAHRAWAT, J.
Shri D.K. Kamthan - Appellant
Versus
State Of Madhya Pradesh And Others - Respondent
Writ Petition No. 14329 of 2018
Decided On : 22-06-2026

Important Points

Non-supply of the Public Service Commission's advice to a delinquent officer violates natural justice. Additionally, quasi-judicial acts performed in good faith by officers (such as Tahsildars) are protected under the Judges (Protection) Act, 1985, and do not constitute misconduct absent proof of ill-motive.

Subject

Service Law - Pension and Departmental Inquiry

Act Referred

CONSTITUTION OF INDIA : Art.226
MADHYA PRADESH CIVIL SERVICES CLASSIFICATION, CONTROL AND APPEAL RULES : R.30
JUDGES PROTECTION ACT : S.2, S.3, S.3(1)

Headnote

The petitioner challenged an order dated 29-05-2018 issued under Rule 9 of the M.P. Civil Services (Pension) Rules, 1976, which imposed a penalty of withdrawing 10% of his pension for two years. The penalty stemmed from a departmental inquiry into government lease orders issued by the petitioner while serving as Tahsildar. The petitioner contended that relevant documents and the advice of the Public Service Commission were not supplied, and that his actions were quasi-judicial and protected under the Judges (Protection) Act, 1985. The court examined whether the non-supply of the Public Service Commission's advice and the enquiry report constituted a breach of natural justice and whether the petitioner's actions amounted to 'misconduct'. The court reasoned that the advice of the PSC, when used against a delinquent officer, must be communicated in advance. Furthermore, it held that a Tahsildar exercising powers under the M.P. Land Revenue Code acts as a 'Judge' under Section 2 of the Judges (Protection) Act, 1985, and is protected under Section 3(1) for acts done in the discharge of official duty. The court further determined that mere negligence or error of judgment without ill-motive does not constitute misconduct. Consequently, present petition stands allowed and disposed of in the following terms: (i) Impugned order Annexure P-1 dated 29-05-2018 is hereby quashed; (ii) Respondents are directed to refund the withheld 10% pension of petitioner of two years with interest at the rate of 6% per annum from the date of retirement till actual payment is made within a period of three months from the date of receipt of certified copy of this order, failing which this amount would carry interest at the rate of 12% per annum from the date of retirement till actual payment is made.
