1. By means of this writ petition, the petitioner has challenged the mode of consideration of his representation on ‘adverse’ entries made in the ACRs (Annual Confidential Rolls). The petitioner has also challenged rejection of his representation for expunging the adverse entries and upgrading the assessment.
2. The controversy hovers around the ACRs for the year 2010-11, 2011-12 and 2012-2013. For the ‘adverse’ entries made in the ACRs by way of grading below the benchmark, the petitioner has been denied the promotion to the next higher post of Tripura Civil Services, Selection Grade (‘TCS Selection Grade’ in short). As consequence, he has been superseded by his juniors viz. the respondents No.13, 14, 15, 16 and 17.
3. The petitioner had been posted for around two years and four months (05.03.2009 to 12.07.2011) in the office of the District Magistrate & Collector, Dhalai District in the capacity of Deputy Collector (when he was in the TCS Grade-II) and then he had served in the capacity of Senior Deputy Magistrate and District Welfare Officer (when he was in the grade of TCS Selection Grade).
