1. National Insurance Co. Ltd. has filed this appeal against the award of the Motor Accidents Claims Tribunal, Manipur (hereinafter referred to as MACT) in MACT Case No. 116 of 2010. On 16.7.2010 while the deceased, Leimapokpam Ingocha Singh and Yumlembam Pishak Singh, were walking on road on Thongjao Awang Leikai at about 8.30 p.m. they were knocked down by the offending vehicle and all of them sustained bodily injuries. The deceased, Jugeshwor Singh, was seriously injured and succumbed to the injuries later while he was being taken to RIMS, Imphal.
2. Claimant No. 1 is the wife of the deceased and the claimant nos. 2 and 3 are the minor daughter and son of the deceased. The owner and driver of the vehicle were made respondent Nos. 1 and 2 before the Tribunal and the present appellant, insurance company, was the respondent No. 3 before the Tribunal.
3. It is the case of the claimants that the deceased was working as a teacher in a private school and was earning Rs. 6,000 per month.
