P.G. Chacko, Judicial Member - We Had directed the appellant to pre-deposit an amount of Rs. 3,00,000/- within six weeks and report compliance to the Assistant Registrar on 26.11.2012 vide Stay Order No. 1728 dated 27.9.2012. The Assistant Registrar has reported that there was no compliance with the above direction. Today, there is no representation for the appellant despite notice, nor any evidence on record, of pre-deposit of the aforesaid amount. The appeal is dismissed for non-compliance with Section 35F of the Central Excise Act as applicable to the Service Tax appeal.
