The appellant is a Customs House Agent registered with the New Customs House, New Delhi. He was issued a show cause notice on 13.1.2000 by the Commissioner of Customs (Gen.), New Customs House, New Delhi, in which it is alleged that during the month of April, 1999, he filed 48 Nos. shipping bills and 32 Nos. Bills of Entry on behalf of different exporters and importers in respect of which, the bills for the services rendered by him are raised on the parties other than the importers/exporters for whom such clearance work had been done, that such bills ought to have been raised to the particular exporters/importers by CHA for services rendered by him. It is alleged that since in these cases, the CHA had not received the payment from the concerned parties directly, leading to the belief that the CHA licence had been transferred to the parties who are not authorised to do customs work. This appears to be in violation of the provisions of Regulations 13 and 14(a) of the Customs House Agents Licencing Regulations (CHALR), 1984.
