1. The instant appeal has been directed by the appellant under S.15 of the C.P. Act, 2019 against the final order / judgment dated 25/10/2019 passed by learned District Commission in CC / 222/2015.
2. The facts of the case, in brief, are that the property, mentioned in the schedule of the petition of complaint, originally was of Susanta Kumar Ghosh, who died intestate, living behind Supriya Ghosh (wife) and his four sons, namely, the complainant and OP No. 1 and Sumit Ghosh. They became owner of one - fifth of the undivided property. Subsequently, Sumit Kumar Ghosh executed a registered deed of conveyance being No. 02249 of 2012 in favour of the complainants and the OP No. 1 so far their two - fifths share is concerned. The complainants and the OP No. 1 executed and registered another deed of conveyance in favour of Sumit Kumar Ghosh donating their share in the rest of the property left by Susanta Kumar Ghosh. Therefore, the complainants and the OP No. 1 got their names mutated both in the local self - Government as well as in the office of BL & LRO, Singur, and used to pay rent and taxes regularly.
