ORDER

Per: SURESH KUMAR BATRA MEMBER (J):-

1. The present Original Application has been filed by the applicant under Section 19 of the Administrative Tribunals Act , 1985 seeking the following reliefs:

(i) Quash/set aside the Memorandum issued vide UO NO. CC/2015/20-IH(II)-2019/18444 dated 03.12.2019 served vide Memo No. 1347/DHE-UT-AD(III)-13/(6)2017 dated 16.12.2019 (AnnexureA-1 Colly) issuing the charge sheet on the same set of the allegations which are subject matter of Criminal Proceedings pending before Addl. Chief Judicial Magistrate in FIR 300 dated 10.07.2019 (u/s 419, 420, 511 IPC P.S. Sadar Thanesar, Kurukshetra) and all consequential orders dated 13.02.2020 appointing the Respondent No. 4 as an Inquiry Officer (Annexure A-2), Order No. CC/2015/20-IH(11)-2020/7144 dated 17.07.2020 (Annexure A-3) whereby the ex-parte inquiry report dated 26.06.2020 (Annexure P-4) submitted by respondent No. 4 whereby the applicant has been directed to submit the representation on findings of the Inquiry report within 15 days failing which the departmental proceedings would be finalized against the applicant ex-parte.
