IN THE HIGH COURT OF CHHATTISGARH AT BILASPUR
Amitendra Kishore Prasad, J
Umakant Mishra – Appellant
Versus
State Of Chhattisgarh – Respondent
WPS No. 6201 of 2023

Advocates:
For the Appellants/Petitioners: Shivang Dubey, Swati Kumari
For the Respondents: Manish Nigam, Dilman Rati Minj

An employee acquitted of criminal charges is entitled to consequential service benefits but cannot claim retrospective promotion, seniority, or financial benefits for periods when they were not in actual service, as no fundamental right exists to promotion and such claims would violate settled service law principles.

Headnote:(A) Constitution of India - Articles 14, 16(1), and 21 - Service Jurisprudence - Promotion and retiral benefits - No fundamental right exists for promotion itself, only a right to be considered for promotion when it arises in accordance with relevant rules - Retrospective promotion or seniority cannot be granted from a date when an employee was not borne in the cadre - Such actions disturb settled rights and are contrary to service jurisprudence. (Paras 15 and 16)

(B) Service Law - Suspension and Termination - Acquittal in criminal proceedings - While acquittal allows for the reinstatement of an employee and payment of consequential service benefits for the period of service rendered, it does not entitle an employee to claim retrospective promotional benefits or compensation for periods where the employee was not in actual service. (Paras 13, 14, and 16)

Facts of the case:
The petitioner, a former government official, was suspended and subsequently terminated following a conviction in a corruption case. Upon successfully appealing the conviction and receiving an acquittal, the petitioner’s termination was cancelled and he was granted superannuation based on his birth date. The petitioner sought additional relief, including selection grade benefits, pro-forma promotion, interest on delayed payments, and monetary compensation for alleged malicious prosecution.

Findings of Court:
The court noted that the petitioner was not in service between the dates of his dismissal and his eventual acquittal. Adhering to settled legal principles, the court held that service benefits cannot be granted retrospectively for periods when the employee was not borne in the cadre. As the petitioner had already received his consequential retiral benefits, there was no legal basis for granting further promotional benefits or additional interest.

Issues: Whether a government employee is entitled to retrospective promotional benefits, enhanced interest on terminal dues, and compensation following an acquittal of criminal charges for a period during which the employee remained out of service due to dismissal.

Ratio Decidendi: Promotion is effective from the date it is granted, not from the date a vacancy arises. An employee who remained out of service during the pendency of a criminal case cannot claim notional seniority or retrospective promotional benefits for the period of non-service, as such claims are contrary to service jurisprudence and would adversely impact the rights of others.

Result: Writ petition dismissed.
