1. These two revision petitions RP 633 of 2017 & 634 of 2017 have been filed by Minu Choudhary and M/s. Shree Devi Store against the order dated 17.10.2016 of the Jharkhand, State Consumer Disputes Redressal Commission, (in short ˜the State Commission') passed in FA No. 20 of 2010 & FA No. 24 of 2010.
2. Brief facts of the case are that the petitioner / complainant owns two shops and the complainant has taken insurance policy from two different Insurance Companies”United India Insurance Co. Ltd. and New India Assurance Co. Ltd. During the currency of the policies, the incident of fire occurred on 17.11.2008 in the shops and all the stuff was gutted. The Insurance Companies paid the amount as per the surveyor report in both the cases.
3. Not satisfied with the settlement of claim by both the Insurance Companies, the complainant filed two consumer complaints, CC Nos. 37 of 2009 and 47 of 2009 before the District Consumer Forum, Bokaro (in short ˜the District Forum'). The District Forum vide its order dated 17.11.2009 allowed the complaint in complaint case No. 37 of 2009 and ordered the opposite party United India Insurance Company to pay Rs. 7.40 lacs to the complainant.
