Kishorbhai Narayandas Maherchandani v. State of Gujarat
1. The petitioner, who is one of the partners of Shree Laxmi Balaji Status, is before this Court, which had floated a scheme for residential flats and shops on the land being Block No. 829 paiki T.P.S. No. 10, F.P. No. 54/1 ('subject land' in brief).
2. The six partners, including the present petitioner, of the partnership firm entered into a Partnership Deed, Dated: 09.02.2010, to carry on the business of real estate, developing and organizing of estate near Balaji Kutir, Adalaj, Ahmedabad, in the name and style of Shree Laxmi Balaji Status. Each partner was having 16.67 or 16.66% share in the said firm. One Shri. Narayandas Sugnomal Maherchandani purchased the subject land, where, the construction work was undertaken and agreements for sale were executed by said Shri. Narayandas Sugnomal Maherchandani and some of the members were also handed over the respective flats booked by them.
2.1. The petitioner is, essentially, before this Court, seeking quashment of the order passed under S.27 of the Consumer Protection Act (in short, 'C.P.
