ORAL ORDER
1. The petitioner is before this Court calling in question an order dated 21.09.2021 passed by the Deputy Commissioner affirming the order passed by the Assistant Commissioner on 28.05.2021 by which the gift that was made in favour of the petitioners by the 3rd respondent is annulled.
3. The parties to the lis are that the 3rd respondent is the father of the 1st petitioner and the 2nd petitioner is the son-in-law of the 3rd respondent. On 02.09.2015, it transpires that the 3rd respondent purchased a property measuring 875 square yards at Koppal. On 12.02.2019 the 3rd respondent executes a gift deed gifting the property to the 1st petitioner to the daughter. Long thereafter alleging that the 3rd respondent has been abandoned and not being taken care off as is necessary in law, the 3rd respondent approaches the Assistant Commissioner invoking Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 .
