114 r/w. Order XLVII Rule 1 of CPC , seeking for review of the order dated 07.02.2024 passed in R.P.No.235/2023, whereby, the order dated 15.02.2023 passed in RFA No.1294/2022 was recalled and RFA No.1294/2022 was restored to file.
3. The brief facts of the case are that, the first petitioner is the daughter and the second and third petitioners are the great-grandsons of late V.Ramalingam Mudaliyar. The second respondent is a Trust created as per the order under the Probate, Will and Testament of late V.Ramalingam Mudaliar dated 10.09.1942. In the said Will, late V.Ramalingam Mudaliar, settler of the second respondent had detailed the charitable activities that are to be undertaken by the Trust.
