The appropriate government may refer disputes for adjudication without determining the employer-workman relationship; such determinations are reserved for the Industrial Tribunal.

Headnote:(A) Constitution of India - Article 226 - Industrial Disputes Act, 1947 - The petitioner-employer challenged references made by the appropriate government regarding former employees claiming they were ‘workmen’ under Section 2(s) of the Act. The court held that an opinion on employment status is not required for reference; it is sufficient to establish a prima facie industrial dispute. The government does not adjudicate facts but makes references for judicial determination. The references by the appropriate government were upheld, leaving the determination of facts to the Industrial Tribunal. (Paras 27.1, 28.1, 29.1, 31.1)

(B) Industrial Disputes - Resignation - The court clarified that a voluntary resignation terminates the employer-employee relationship unless proven otherwise. If resignations were forced, the relationship may not cease, warranting a reference for adjudication. (Paras 28.11)

Findings of Court:
The appropriate government was justified in its references, and the merits of whether a person is a workman remain within the purview of the Industrial Tribunal. References were made to ascertain the existence of a dispute following multiple resignations claimed to be coerced during a tumultuous employment period amidst COVID-19. (Paras 27.4, 29.2)

i. Issue a Writ of Certiorari or any appropriate order quashing the Order of Reference dated 07.01.2022 in No. Kaa.e/383/ idg/2021(Annexure-T) passed by Respondent No.1;
