O R D E R
The challenge in this revision petition is to the order dated 24.05.2024 in Crl.M.P.No.2448 of 2024 in S.C.No.639 of 2024 passed by the Additional Sessions Court-V, Thriuvananthapuram. The petitioner is accused No.10 in the case. The petitioner and the other accused are alleged to have committed offences punishable under Sections 120 (b), 447, 427, 396, 212 and 302 of the IPC and Section 27 of the Arms Act .
2. The prosecution case is that the petitioner and the other accused hatched a criminal conspiracy on different days at various places to murder Shaji @ Mottamoodu Shaji. In furtherance of the conspiracy, accused Nos. 1 to 9 assembled, armed with deadly weapons, with the common intention to commit dacoity and murder of Shaji. They trespassed into the front courtyard of the residence of Shaji and hacked him. Shaji succumbed to the injuries on the spot. His friend Vinod who was present there also sustained grievous injuries and he succumbed to the injuries in the hospital. The accused looted a sum of Rs.2,69,000/- from the possession of the deceased. They also caused damages to a car owned by Shaji.
