J U D G M E N T

Ajithkumar, J The petitioners are the respondents-tenants in the R.C.P.

No.89 of 2018 on the file of the Rent Control Court(Munsiff), Ernakulam. They filed interlocutory application No.8348 of 2019 in the RCP for appointment of a commission. That application was allowed as per Ext.P4 order dated 07.01.2020 in part. Since a few queries were disallowed, the petitioners filed Review Petition No.3 of 2020. The Rent control Court dismissed the review petition. This original petition, under Article 227 of the Constitution of India is filed challenging legality of Ext.P7, the order in the Review Petition.

2. The Rent Control Petition was filed by the respondents seeking eviction under Sections 11 (2)(b), 11(4)(iii) and 11(8) of the Kerala Buildings (Lease and Rent Control) Act, 1965 . The petitioners filed objections resisting the claim for eviction. They took up a contention with reference to the requirement of additional accommodation urged by the respondents, that the appellants are owners of two other shopping complexes in the locality and that the petition schedule room does not suit to the requirements of the respondents.
