This Bail Application is filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita .

2. The petitioner is the accused in Crime No.

671/2024 of Vazhakkad Police Station. The above case is registered against the petitioner alleging offences punishable under secs. 20(b)(ii)B and 29 of the Narcotic Drugs and Psychotropic Substances (for short 'NDPS') Act.

3. The prosecution case is that on 09.08.2024, the accused Nos. 1 to 3 were found in possession of 1.320 kgs of Ganja in a house bearing building No. 2/75 of Cheekode Grama Panchayat for the purpose of sale and thus committed the offences. The petitioner was arrested on 09.08.2024. The petitioner is a Bangladeshi National.

4. Heard the learned counsel for the petitioner and the Public Prosecutor.

5. The counsel for the petitioner submitted that the co-accused namely, accused Nos. 1 and 3 were already released on bail as per order dated 15.10.2024 in BA No. 8133/2024. The counsel submitted that the petitioner is ready to abide any conditions, if this Court grants him bail. The Public Prosecutor opposed the bail application. The Public Prosecutor submitted that, if the petitioner is released on bail, he will not be available
