ORDER :
This Bail Application is filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita .
2. Petitioner is the accused in Crime No.151/2024 of Karunagappally Police Station. The above case is registered against the petitioner alleging offences punishable under Sections 420 r/w 34 IPC and Secs. 43 r/w 66, 66(C), 66(D) of the Information Technology Act (for short 'IT Act').
3. The prosecution case is that the defacto complainant dialed to some phone number for registering complaint with bank customer care. The accused attended the phone call sent a link by SMS to the defacto complainant, which according to the prosecution is an application to obtain one time passwords received in the phone of the defacto complainant, whereby during the period between 15.01.2024 to 20.01.2024 in three intervals, the accused obtained a total amount of Rs.9,80,000/-.
4. Heard counsel for the petitioner and the Public Prosecutor.
5. The counsel for the petitioner submitted that the petitioner is in custody from 15.01.2025. The counsel submitted that the petitioner is ready to abide any conditions, if this Court grants him bail. The Public Precursor opposed the bail application. The counsel for the
