The court clarified the specific requirements needed to prove offences under the SC/ST (PA) Act, distinguishing them from general IPC offences.

This Criminal Miscellaneous Case is filed to quash the proceedings in S.C.No.116/2019 on the file of District & Sessions Court (SC/ST Act), Kottayam. The petitioner is the sole accused in the above case. The above case is charge sheeted alleging offences punishable under sections 3(1)(r), (w)(i) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 [for short, ‘the SC/ST (PA) Act’]. The offences under sections 448, 294(b), 324 and 354 of the Indian Penal Code are also alleged.

2.The prosecution case is that, on 03.09.2018 at 7 p.m., the accused persons trespassed into the sit-out of the house of the defacto complainant and assaulted her husband by pushing him down and when the defacto complainant tried to interfere, the accused person torn off her dress and beaten her with an iron rod on her leg and showered her with filthy language and thereby outraged her modesty. Since the defacto complainant belongs to the Scheduled Caste offences under the SC/ST (PA) Act is also alleged. Hence it is alleged that the accused committed the offences.

3.According to the petitioner, even if the entire allegations are accepted, the offences under the SC/ST (PA) Act are not attracted.

6.The allegation is that the petitioner committed the offences under Sections 3 (1) (r) and (w)(i) of SC/ST (PA) Act. It will be better to extract Section 3 (1)(r) and (w)(i) of the SC/ST (PA) Act:

3(1)(r) : intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste or a Scheduled Tribe in any place within public view.

3(w)(i) : intentionally touches a woman belonging to a Scheduled Caste or a Scheduled Tribe, knowing that she belongs to a Scheduled Caste or a Scheduled Tribe, when such act of touching is of a sexual nature and is without the recipient's consent.

7.To attract the offence under Section 3 (1)(r) of the SC/ST (PA) Act, the prosecution has to prove that the accused intentionally insults or intimidates with intent to humiliate a member of a Scheduled Caste or Scheduled Tribe in any place within public view. Similarly, to attract the offence under (w)(i), the accused intentionally touches a woman belonging to a Scheduled Caste or a Scheduled Tribe, knowing that she belongs to a Scheduled Caste or a Scheduled Tribe, when such act of touching is of a sexual nature and is without the recipient's consent.

8.I am of the considered opinion that, even if the entire allegations are accepted, the offences under Sections 3 (1)(r) and (w) (i) of the SC/ST (PA) Act are not attracted. If that is the case, the same is to be set aside. But the petitioner has to face trial for the offences under Sections 448, 294(b), 354 and 324 IPC before the
