O R D E R

Petitioner is the accused in C.C. No.1753/2017 on the file of the Judicial First Class Magistrate Court, Muvattupuzha arising from Crime No. 1698/2017 of Muvattupuzha Police Station. The above crime was registered by the police alleging offences punishable under Sections 118 (e) of the Kerala Police Act and Section 132 (1) r/w Section 179 of the Motor Vehicles Act . Annexure A1 is the first information report.

2. The allegations against the petitioner is that the petitioner being the driver of a Scooter bearing Reg. No.KL- 17N-4970 while driving the said motor cycle from Puzhakkarakkavu Station Junction Road from South to North in a rash and negligent manner causing danger to life of the public. On 02.05.2017 at 6:30 pm, when the defacto complainant showed hand to stop the vehicle, the petitioner did not stop the vehicle and violated the signal is the allegation. It is further alleged that the petitioner had not used helmet and thereby committed another offence. The police registered Crime No.1698/2017 on 02.05.2017 and after investigation, submitted the final report on 03.05.2017 and the case was taken on file as C.C.No. 1753/2017 by the learned Magistrate.
