JUDGMENT DEVAN RAMACHANDRAN (J)
The appellant assails the judgment of the learned Family Court, Muvattupuzha, in O.P.No.808/2020 - filed by her against the respondent seeking divorce - since it has been dismiss it.
2. The appellant filed the Original Petition aforementioned, alleging that the respondent had treated her with utmost cruelty; but the learned Family Court found against her, to thus dismiss.
3. Smt.N.S.Hasna Mol – learned counsel for the appellant, submitted that the evidence of her client as PW1, narrates the horrendous illtreatment that she had suffered throughout the time when she was living with the respondent; but that all such have been refused to be believed by the learned Family Court, merely because she had chosen not to file police complaints on each of such instances. She argued that her client belongs to a Scheduled Caste/Scheduled Tribe Community and was unable to move the police, as in the case of many women going through such situations; and hence that this could not have been used against her in blame, to find that whatever she stated against the respondent is unsubstantiated.
