ORDER Dated : 20th November, 2025 The petitioner is the accused in S.C.2281/2022 on the file of the Fast Track Special Court-II, Neyyattinkara, arising out of crime No.1399/2020 of Neyyattinkara police station. The offences alleged against the petitioner are punishable under Sections 376 (2)(n) and 506(i) of IPC . He filed this revision petition being aggrieved by the order of the Fast Track Special Court-II, Neyyanttinkara in C.M.P.180/2025 dismissing the said petition for discharge.
2. The prosecution case is that the accused who is the first cousin of the de facto complainant, one one day in April, 2012, committed rape upon the de facto complainant at the bed room of her house, intimidated to do away with her in case she divulges about the same to others. It is also alleged that, thereafter, after promising to marry her, he repeatedly committed sexual intercourse with her and thereby he is alleged to have committed the aforesaid offences.
3. According to the learned counsel for the petitioner, this is a false case foisted against the petitioner and also that he is innocent in this case. According to the learned counsel, even if the entire allegations raised against the petitioner
