Headnote:(A) Land Acquisition Act, 1894 - Section 11(2) - Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 - Challenge to award - Writ petition filed 7 years after award rejected due to inordinate delay and lack of explanation - The court upheld the view that under the 2013 Act, awards under the repealed 1894 Act are not valid if not compliant with required procedures. (B) Delay and Laches - The principle that writ petitions must be filed within a reasonable timeframe, especially after possession has been taken, was reiterated, emphasizing the importance of timely action in judicial proceedings. (Paras 8, 9.1, 9.4)

Facts of the case:
The appellant, a registered company, challenged an award given under the 1894 Act, claiming it was void due to improper procedure post-2013 Act implementation. The writ petition was filed after receiving compensation.

Findings of Court:
The court ruled the learned Single Judge improperly entertained the writ petition, allowing for the resurrection of a stale claim and disregarding objections raised by authorities.

Issues: The main issues were whether the delay in filing the writ petition was justifiable and the maintainability of a challenge to an award after substantial compensation was received.

Ratio Decidendi: The court placed significant weight on the doctrine of laches, thus protecting the rights of third parties and ensuring that judicial resources are not used to revive stale claims.

A. Muhamed Mustaque, J.

The learned Single Judge considered a question regarding a challenge to an award passed under Section 11 (2) of the Land Acquisition Act, 1894 (hereinafter referred to as the “1894 Act”), based on an agreement entered into between the land owner and the Collector. This award was passed on 22/08/2014. The writ petition was filed challenging the award before this Court on 22/03/2021. The learned Single Judge issued a direction to the Special Tahsildar to consider whether he could issue such an award after 01/01/2014, the date on which the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 , (hereinafter referred to as the “2013 Act”) came into force, and if he was of the view that he had no authority, he shall withdraw the award.
