The court affirmed the right to an expeditious decision on pending applications related to land conservation, contingent on proper compliance with application procedures.

JUDGMENT

The above writ petition is filed seeking the following reliefs:

“(i) To issue appropriate writ, order or direction to the 6^th respondent to consider Ext.P7 application and to forward the same with the recommendations to the 7^th respondent, within a time limit, in the interest of justice.

(ii) To issue appropriate writ, order or direction to the 7^th respondent to consider Ext.P8 representation and call for the records from 6^th respondent LLMC and to conclude the entire proceedings within a time limit, in the interest of justice.

(iii) To grant such other reliefs which this Honourable Court may deem fit and proper in the interest of justice.” [SIC]

The main prayer in this writ petition is to issue a direction to the 6^th respondent to consider Ext.P7 application, in accordance with law, which according to the petitioner is submitted in Form-5 of the Kerala Conservation of Paddy Land and Wetland Rules , 2008. 3. Heard the learned counsel appearing for the petitioner and the learned Government Pleader.

4. After hearing both sides, I am of the considered opinion that this writ petition need not be retained here. This writ petition was filed in the year 2022. There can be a direction to the 6^th respondent to consider Ext.P7, if it is pending as on today and if it is in order. If it is not in order, the 6^th respondent will inform the same to the petitioner, so that the petitioner can do the needful, in accordance with law.

Therefore, this Writ Petition is disposed of with the following directions:

1. The 6^th respondent is directed to consider Ext.P7 and pass appropriate orders in it, if it is pending as on today and if it is in order, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a certified copy of this judgment.

2. If there is any defect in Ext.P7, the 6^th respondent will inform the same and the petitioner is free to cure the defect also.
