The present intra court appeal under Section 5 of the Kerala High Court Act , 1958 assails the judgment dated 03.04.2024 passed in W.P.(C) No.6546 of 2024 whereby the learned Single Judge has dismissed the Writ Petition.
2. The brief facts of the case are that the appellant’s father is an employee under the first respondent bank. The father met with a tragic accident on 21.08.2020 and became permanently dis- abled. According to the Medical Certificate Ext.P4, he has 100% disability. The appellant had filed the Writ Petition claiming com- passionate appointment under the dying in harness scheme, un- der Rule 188A of the Kerala Co-operative Societies Rules , 1969 (for short ‘the Rules’) on the ground that after the tragic accident of his father, his family finds it very difficult to pull on and to make both the ends meet. Therefore, the appellant submitted an appli- cation seeking compassionate appointment Ext.P11, before the first respondent. Vide Ext.P14 communication dated 10.02.2023, the application for compassionate appointment was rejected on the ground that compassionate appointment can only be granted to the dependents of the employ
