JUDGMENT

This writ petition is filed with following prayers:

i. issue a writ of mandamus or any other writ, or order to the first respondent to pass orders on Exhibit P3 at least by 15-03-2026.

ii. declare that the first respondent is bound to pass orders on an application in Form 6, expeditiously.

iii. command the first respondent to allow the Ext.P3 application, changing the status as applied for, forthwith.

iv. exempt the petitioner from producing the English Translation of Malayalam Exhibits produced along with this writ petition, and the petitioner further undertake that he is ready and willing to produce an English Translation of Malayalam documents as and when required;

v. award cost to the petitioner;

vi. issue any other writ order or direction as this Hon’ble Court may deem fit in the facts and circumstances of the case;

2. The main prayer in this writ petition is to issue a direction to consider Ext.P3 Form-6 application submitted under the Kerala Conservation of Paddy Land and Wetland Rules , 2008. The counsel for the petitioner submitted that the 3rd respondent already submitted necessary report to the 1st respondent. It is also submitted that the petitioner want to dispose the property and the prospective buyer intimated about 6 months back that if only the conveyance can take place before 31.03.2026, they can purchase the property. The counsel submitted that, as evident by Ext.P2, the Form-5 order is already passed, and the report of the Village Officer is also received by the authorised officer; and therefore, there may be a direction to consider the Form-6 application on or before 31.03.2026. The Government Pleader seriously objected the same and the submitted that several applications are pending and if this Court issue such a direction, that will be precedent.

3. Taking into consideration the peculiar facts and circumstances of the case, the time to dispose the application can be reduced to two months. The authorised officer will try to dispose the Form-6 application taking into consideration the grievance raised by the petitioner, as expeditiously as possible.

Therefore, this Writ Petition is disposed of in the following manner:

The 1st respondent is directed to dispose the Form-6 application, in the light of the report submitted by the 3rd respondent, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a certified copy of this judgment.
