WA NO. 3221 OF 2025 | WP(C) NO.21198 OF 2025

Judicial respect for coordinate bench decisions limits further appeal interference.

Headnote:The appeal concerns the common judgment delivered on 01.08.2025 in W.P.

(C) No. 21198 of 2025. The Court found no compelling reason to interfere with the earlier ruling by a coordinate Bench, which modified the original judgment. The appeal was thus dismissed in alignment with the decision in the case of Joy.

Dated the 24th day of February, 2026 K. Natarajan, J.

This appeal is filed by the State against the common judgment dated 01.08.2025 passed by a learned single Judge of this Court in W.P.(C) No. 21198 of 2025.

2. During the pendency of this appeal, it is brought to our notice that several writ appeals were filed against the very same common judgment before a coordinate Bench of this Court and the same were disposed of on 16.01.2026 modifying the impugned common judgment dated 01.08.2025. The said decision is reported in Kerala State Road Transport Corporation v. Joy [2026 KLT Online 1066] .

3. In view of the decision cited supra and the fact that relying on the said judgment, this Court also disposed of W.A Nos. 3139 of 2025 and 3127 of 2025 on 10.02.2026 and 21.01.2026 respectively, we do not find any further ground to interfere or reconsider the impugned judgment passed by the learned single Judge of this Court, which was already modified by the coordinate Bench of this Court.

Therefore, this appeal deserves to be disposed of.

Accordingly, this appeal is disposed of in terms of the decision in Joy (supra). Interlocutory applications, if any, pending shall stand closed.
