Litigants must first seek resolution from the Family Court before escalating matters to the High Court.

Headnote:The petitioners sought a directive for the timely disposal of OP No.1394/2023 pending before the Family Court. The court cited prior ruling, stating that litigants must initially approach the Family Court for expeditious resolution before seeking remedies from the High Court. The petition was dismissed with leave to invoke legal remedies.

The petitioners seek that OP No.1394/2023 on the files of the learned Family Court, Irinjalakuda, be directed to be taken up and disposed of within a time frame to be fixed by this Court.

We are afraid that we cannot intervene at the first instance because this Court has, in Shiju Joy A. v. Nisha [ 2021 (2) KLT 607 ], rendered it clear that the litigants must approach the learned Family Court itself for early disposal and only then invoke the remedies before this Court.

The petitioners admit that they have yet not done so.

In the afore circumstances, this Original Petition is dismissed; however, leaving liberty to the petitioners to invoke all remedies as may be available in law.
