The court finds no grounds for unfreezing a bank account due to unresolved suspicions of transactions, directing the bank to perform Enhanced Due Diligence.

Headnote:The Writ Petition seeks to unfreeze a bank account, following freezes imposed by the bank due to suspicions from law enforcement. The Court concludes that without proper resolution of disputes about unknown transactions facilitated by the petitioner, no relief can be granted. It directs the bank to conduct Enhanced Due Diligence (EDD). The petition is dismissed accordingly.

JUDGMENT

Dated this the 10th day of March, 2026

1. The Petitioner has filed this Writ Petition seeking direction to unfreeze his account maintained with the Respondent No.1.

2. The learned Standing Counsel for the Respondent No.1/Bank, on instructions, submitted that the Bank has effected credit freeze on account of the suspicion entertained by the Bank. Further, the Bank has received two requisitions from the Respondent No.3 for Rs.3,02,000/- and Rs.944.20 and another requisition from the Respondent No.2 for debit freeze without showing any amount. Though notice was served on the Respondent No.2, there is no appearance for the Respondent No.2.

3. The learned Government Pleader has filed a Memo dated

16.01.2026 producing the Statement of the Respondent No.5 who recorded the statement of the Petitioner, who has been working abroad, through WhatsApp to the effect that the Petitioner has permitted operation of his account through another person for the disputed transactions and Petitioner does not know the disputed amounts which are credited in the account of the Petitioner.

4. In such case, no relief can be granted in favour of the Petitioner. Accordingly, this Writ Petition is dismissed, directing the Respondent/Bank to conduct EDD and to take further action in accordance with Abdul Azeez v. Union .
