IN THE HIGH COURT OF KERALA AT ERNAKULAM
P.V.Kunhikrishnan, J
Abdul Gafoor – Appellant
Versus
State Of Kerala – Respondent
WP(C) NO. 20580 OF 2026

Advocates:
For the Appellants/Petitioners: Sidharth O., Susanth Shaji, Albin A. Joseph, Nekha Varghese, Shanavas P.
For the Respondents: Joemon Antony

State authorities are legally obligated to process land conversion applications under environmental conservation laws within a stipulated time frame to ensure administrative compliance and justice.

Headnote:The petitioners challenged the inaction of statutory authorities regarding an application filed under the Kerala Conservation of Paddy Land and Wetland Rules, 2008. The petitioners sought a writ of Mandamus to direct the authorities to process the pending application to regularize land use. The Court, upon hearing the parties, found that a time-bound disposal of the pending application was warranted in the interest of justice. The main issue was whether the statutory authority is obligated to decide upon an application submitted for land conversion within a reasonable timeframe. The Court reasoned that statutory applications must be processed as per established procedures under the relevant conservation rules to ensure administrative efficiency and legal compliance. The writ petition was disposed of with a direction to the concerned Agricultural Officer to submit a report within one month and the Revenue Divisional Officer to pass final orders within three months thereafter.
