O R D E R
This petition is filed seeking quashment of FIR registered against the petitioner for the offences under Sections 143, 341, 283 of IPC and Sections 41(A) and 71A(1) of the Tamil Nadu City Police Act, 1888.
2.According to the prosecution, on 15.11.2019 at about 04.00 p.m.
when the respondent police were patrolling near Gandhi Market Vellamandi and Ramakrishna Bridge, the petitioner along with 133 members assembled without obtaining prior permission causing disturbance to the public. Thereby respondent police have registered FIR in Crime No.664 of 2019 against the petitioner and others for the offences punishable under Sections 143, 341, 283 of IPC and Sections
41(A) and 71A(1) of the Tamil Nadu City Police Act, 1888.
3. It is submitted by learned counsel for the petitioner that the petitioner and others were protested peacefully without causing disturbance to anybody and as a part of his business the petitioner needs to travel abroad thereby, sought for quashment of FIR. It is also submitted that three years have been lapsed from the date of alleged occurrence of offences thereby taking cognizance is hit by Section 468 of Cr.P.C.
