O R D E R
This Criminal Original Petition has been filed seeking to quash the FIR registered in Crime No.301 of 2024 on the file of the respondent for the offence under Section 379 of IPC .
2. The case of the prosecution is that the accused had broke open the Hundi and had stolen the jewels, silver articles and case to the tune of Rs.15 Lakhs. Hence, the complaint.
3. The learned counsel appearing for the petitioner would submit that there are two rival groups and that a false case has been foisted as against the petitioner due to enmity.
4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the investigation is still pending.
5. Heard the learned counsel appearing on either side and perused the materials available on record.
6. A perusal of the records reveals that there are totally five accused, in which the petitioner is arrayed as A3. Admittedly, he was acted as Poosari in the said temple and is alleged to have broken
