COMMON JUDGMENT

Initially O.P.No. 529 of 2021 had been filed by M.R.Anusuya seeking grant of Letters of Administration with Will annexed relating to a Will dated 23.12.2013 registered as Document No. 84 of 2013 on the file of the Sub Registrar, Villivakkam, Chennai, said to have been executed by her mother P.N.Vasundara, who died on 12.02.2020. In the said Original Petition, the petitioner had impleaded as respondents R.Akshaya and R.Muraalidaran, daughter and son of her deceased sister M.R.Anuradha. On caveat being filed by the respondents, O.P.No. 529 of 2021 had been converted as T.O.S.No. 15 of 2022.

2. The defendants in the aforementioned Testamentary and Original Suit, R.Akshaya and R.Muraalidaran and also their father S.Ragavan had filed O.S.No. 2548 of 2021 before the XXII Additional City Civil Court at Chennai against Anushiya / plaintiff in T.O.S.No. 15 of 2022 seeking a preliminary decree and judgment for partition of the schedule items of properties into two equal shares and allot one such share to the plaintiffs with separate possession and to pass a final decree by appointing an Advocate Commissioner to divide the properties into two equal shares and to allot one such
