ORDER

The writ petition is filed praying for a writ of Certiorarified Mandamus challenging the order dated 17.10.2014, passed by the 2nd respondent under No.MAS-765379, quash the same and consequently direct the 2nd respondent to take on record the evidence in support of opposition filed by the petitioners in the aforesaid opposition proceedings.

2. Brief facts:

2.1. Learned counsel for petitioners would submit that petitioners are part of the Rolls-Royce Group, a contemporary, global engineering company operating in the aerospace, defence, marine and energy markets. It is stated that petitioners registered their logo consisting of two “Rs” or the “double R”, which stands for “Rolls” and “Royce”, the surnames of the founders. The RR logo/monogram was registered and is being used in more than 80 countries across the world. While so, petitioners came to know that the 3rd respondent filed an Application in Application No.182490, for registration of the mark in Class 42.

2.2. Aggrieved by the same, petitioners filed a Notice of Opposition dated 27.08.2010 before the Trade Marks Registry, against registration of the trademark that is sought to be registered under Application No.1820490. The
