Mutation of property in revenue records does not confer title and must await the outcome of a civil suit regarding ownership.
Headnote:(A) Madhya Pradesh Uccha Nyayalaya (Khand Nyaypeeth Ko Appeal) Adhiniyam, 2005 - Section 2(1) - M.P. Land Revenue Code, 1959 - Section 44 and 51 - Writ appeal challenging mutation of land ownership based on sale deed - The court emphasized that mutation does not confer title and must await civil suit outcomes. (Paras 4, 8, 10, 11)
(B) Legal Principle - Mutation of property in revenue records does not create or extinguish title; it is relevant only for land revenue collection. (Paras 9, 10)
Facts of the case:
The appellants, legal heirs of Barkatullah, contested the mutation of land in favor of respondents based on a sale deed, arguing it was impermissible without a civil suit outcome.
Findings of Court:
The court found that the mutation order was issued improperly during the pendency of a civil suit regarding title.
Issues: The main issues were whether the mutation based on a sale deed was valid and the implications of pending civil litigation on such matters.
Ratio Decidendi: The court ruled that mutation entries do not confer title and should not be made while a civil suit is pending, reaffirming the necessity of following civil court outcomes.
Result: Writ appeal allowed.
Heard finally with the consent of both the parties.
