ORDER
1/ Learned counsel for the respondent No.2 submits that this Criminal Revision is not maintainable and as per the law laid down by the Hon'ble Apex Signature NoCt Voeurirfite,d this Criminal Revision cannot be converted into the M.Cr.C. under Signed by: TRILOK SINGH Signing time: 03S-Aeprc-2t3ion 482 of Cr.P.C.
2/ Both the parties heard on IA No.3338 of 2023 and also on the point of maintainability of this revision. Petitioner has filed this IA for conversion of this Criminal Revision into the M.Cr.C. under Section 482 of Cr.P.C.
3/ Present criminal revision has been filed by the petitioner seeking relief to set aside the impugned order dated 11.11.2022, whereby the trial Court has directed that first of all examination-in-chief of the prosecution witnesses- complainant Manish, Rajat and Shantilal will be recorded and thereafter the accused will avail the opportunity of cross-examination of the aforesaid witnesses.
4/ The Hon'ble Apex Court has issued certain directions and guidelines under Section 233(2) of Cr.P.C. and clarified the circumstances in which deferral may be allowed.
