JUDGMENT This criminal appeal under section 374 (2) of the Cr.P.C, 1973 is being preferred being aggrieved by the judgment dated 03.11.1998 in Sessions Case No.14/97 by Ist Additional Sessions Judge, Shajapur whereby the appellant has been convicted under section 324 of the IPC for causing voluntary injuries to Gopal (PW/3), Leelabai (4), Mansingh (PW/5) and Sundarbai (PW/6) and under section 307 of the IPC for attempting to murder of Gangaram (PW/8) and sentenced to 2 years RI and fine of Rs.5,000/- with default stipulation of two months RI for each count of section 324 of the IPC and 5 years RI and fine of Rs.1,000/- with default stipulation of 4 months RI.
2. Facts in brief are that a total 3 persons viz. Allanoor (present appellant), Nazir Kha (acquitted) and Ibrahim Kha (acquitted) were Signature Not Verified Signed by: HARIKUMAR prosecuted for charges under sections 324 r/w section 34 (4 counts) and section 307 r/w 34 of the IPC regarding the incident dated 29.11.1996 at or about 8.30 a.m in village Leema Chouhan, police station Chapiheda, district Rajgarh and regarding which a crime no.133/96 was registered at PS Chapiheda on the basis of Ex.P/1 lodged by Mangilal.
