1. The present First Appeal has been filed under Section 19 of the Consumer Protection Act, 1986 (for short “the Act”) assailing the Order dated 18.02.2019 passed by the State Consumer Disputes Redressal Commission, Punjab (hereinafter referred to as the “State Commission”), by M/s TDI Infrastructure Ltd. (hereinafter referred to as the Appellant/Opposite Party) against Mr. Mukul Syngal (hereinafter referred to as the Respondent/Complainant).
2. Brief facts of the case as narrated in the Complaint are that the Complainant applied for a commercial space in the Opposite Party’s project, “TDI Business Centre, Mohali” intending to shift his business for better opportunities and self- employment, after being misled into believing that all necessary government approvals were in place and possession would be handed over within 36 months from the date of execution of an agreement. The Complainant paid Rs.3,20,000/- as registration in 2008 and later made substantial payments totalling over Rs.33 lakhs by 2013 out of Rs.39,01,709/-. The Complainant stated that his allotted commercial space was unilaterally changed from F9-027 to F11-028 without his consent.
