Sashikanta Mishra,J. An important question arises for determination in the present Writ Petition – whether the appointment/promotion of an Asst. Teacher of an Aided Educational Institution to the post of Headmaster of the said School by the Managing Committee without obtaining prior approval of the competent authority as required under the Rules is valid. Consequentially, whether the order of the competent authority in invalidating such appointment on the ground of absence of prior approval by the competent authority warrants any interference by this Court in the present Writ Petition.

2. The facts of the case lie in a narrow compass for which it is not necessary to delve into the pleadings of the parties in extenso. It would suffice to note that the Petitioner, after facing a process of selection was appointed as an Asst. Teacher in Ramaranga Aided U.P.(M.E.) School, Ramaranga in the District of Cuttack on 14th August, 1990 and also joined in the said post on the same day. His appointment was approved on 15th May, 1993 by order passed by the Inspector of Schools, Cuttack Circle, Cuttack. The post of Headmaster of the School fell vacant on and from 3rd May, 2008 d
