CRM-39123-2025 This is an application for preponing the date of hearing of the main case which is stated to be fixed for 14.01.2026.
For the reasons stated in the application, the same is allowed and the date of hearing in the present appeal is hereby preponed from 14.01.2026 to today itself i.e. 30.09.2025.
Main case
1. The applicant has filed the present application seeking for leave to appeal against the judgment of acquittal, passed in a complaint case instituted under Section 138 of Negotiable Instruments Act, 1881 (hereinafter referred to as ‘NI Act’), whereby, a complaint filed by the applicant was dismissed and the accused acquitted.
2. The limited question arising for consideration in the present proceedings is whether an appeal against a judgment of acquittal passed by the Court of learned Sub Divisional Judicial Magistrate, Samalkha in a complaint case, with regard to commission of offence punishable under Sect
