The pro-rata calculation of pensionable salary is inapplicable to higher-wage contributors under the pension scheme. Administrative circulars cannot override statutory rules, and there must be complete parity between wages considered for contribution and those used to calculate pensionable benefits, with interest payable on delayed retiral dues.

Headnote:(A) Employees' Provident Funds and Miscellaneous Provisions Act, 1952 - Section 6A - Employees' Pension Scheme, 1995 - Paragraphs 11 and 12 - Pension computation on higher wages - Pro-rata methodology - Pro-rata calculation of pension is a statutory requirement for wage-ceiling cases, however, it finds no application to cases where employees and employers opted to contribute on actual higher salary under Para 11(4) - Executive instructions or internal circulars cannot override statutory rules framed under the Act - Pension is a vested right and a measure of socio-economic justice, not a matter of grace - Delay in disbursement of pensionary benefits entitles retirees to interest. (Paras 12, 13, 16, 17, 22, 27)

(B) Interest on delayed payments - Reciprocity in equity - When the authorities levy interest on arrears of contribution, they cannot deny interest on delayed pension arrears - Pensioner is entitled to interest on the arrears calculated from the expiry of the prescribed period until the actual date of disbursement at compound rates corresponding to the interest charged by the authorities. (Paras 29, 31, 32)

(C) Parity in wage consideration - Disparity in contribution and pensionable salary - Statutory bodies must ensure complete parity between wages utilized for collection of contributions and those used for fixation of pensionable salary - Failure to apportion arrears of allowances to the relevant months to create a lower pension basis is illegal and arbitrary. (Paras 33, 34, 35)

Facts of the case:
Numerous writ petitions were filed by retired employees challenging the application of a pro-rata formula to calculate pensionable salary for those who opted to contribute on actual higher wages under the pension scheme. The authorities introduced a pro-rata bifurcation post-2014, which the petitioners contended was inconsistent with the scheme and their entitlement, as they had already paid differential contributions with interest.

Findings of Court:
The Court observed that pro-rata computation is confined to wage-capped members and has no statutory basis for higher-wage contributors. The administrative circulars mandating this for higher wages were found to be ultra vires the scheme. The Court determined that the pensionable salary must be based on the average monthly pay during the 60 months preceding retirement without pro-rata reduction.

Issues: Whether the application of the pro-rata formula for pension calculation in higher-wage cases is valid; whether retirees are entitled to interest on delayed pension arrears; and whether there is an unjustified disparity between contribution and benefit calculations.

Ratio Decidendi: The court ruled that the pro-rata formula is restricted to statutory wage-ceiling cases and cannot be imported into higher-wage cases through executive instructions, as administrative circulars lack the power to amend statutory rules. The court emphasized the principle of reciprocity, noting that if the authorities charge interest for delayed contributions, they must pay interest for delayed retiral benefits.

Result: Petitions allowed. The circulars prescribing the pro-rata methodology for higher-wage cases were quashed, and authorities were directed to recalculate pensions with interest on arrears.
