R. Sathyabama, J, Niva Singh, Technical Member
ARCHANA W/O ANIL SAWALEKAR – Appellant
Versus
GM CR – Respondent
OA (II U) / MCC /164/2023

Important Points

Compensation under Section 124-A of the Railways Act, 1989, is not payable if the death results from self-inflicted injury or acts committed in a state of intoxication, such as unauthorized trespassing across tracks, as these do not constitute an "untoward incident."

Subject

Civil - Railway Claims

Act Referred

Headnote

(A) Untoward Incident - Bonafide Passenger - Mere possession of a railway ticket is insufficient to establish that the deceased was travelling by train; admission of trespassing and intoxication negates the claim of an untoward incident. (Para 13)

(B) Compensation - Exception Clauses - Death resulting from crossing tracks while intoxicated or feeling dizzy constitutes "self-inflicted injury" or an act in a state of intoxication under Section 124-A of the Railways Act, 1989, exempting the railway administration from liability. (Para 18, 21)

Issues: Whether the deceased was a bonafide passenger and whether the incident was an "untoward incident" under the Railways Act, 1989.

Advocates:
For the Appellants/Petitioners: None
For the Respondents: Shailja Nair
