IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
Namavarapu Rajeshwar Rao, J
M/s Link Transport Co – Appellant
Versus
Kirby Building Systems and Structures India Pvt. Ltd – Respondent
CIVIL REVISION PETITION No.2313 of 2025

Advocates:
For the Appellants/Petitioners: V. Seetha Rama Avadhani
For the Respondents: Hirendernath

While an arbitral award can generally be executed where assets are located, if assets are available within the jurisdiction of the court overseeing the arbitral proceedings (the seat), there is no legal necessity to invoke the jurisdiction of another court.

Headnote:The petitioner sought execution of an arbitral award dated 24.12.2020 for a sum of Rs.45,15,771/-. The execution petition (E.P. No.402 of 2022) was filed before the III Addl. District Judge, Sangareddy, for attachment of properties in Medak District. The trial court dismissed the petition, observing that jurisdiction was ousted by Section 42 of the Arbitration and Conciliation Act, 1996, as the agreed venue and seat of arbitration was Hyderabad. The primary issue was whether an execution petition can be filed in a court where assets are located (Sangareddy/Medak) despite the seat of arbitration being elsewhere (Hyderabad), especially when assets are also available at the seat. The court analyzed Section 42 of the Arbitration and Conciliation Act, 1996, and the principle that while execution can generally be filed where assets are located, the presence of assets at the designated seat of arbitration and the existence of a challenge to the award (AOP No.59 of 2022) in the seat's court make the local filing unnecessary and improper. The Civil Revision Petition is dismissed by confirming the order dated 27.03.2025 passed in E.P. No.402 of 2022 in Arbitration case No.1 of 2020 before the Court of the III Addl. District Judge, Sangareddy.

An agreement was entered into between the petitioner company and the respondent organization for the transportation of the respondent's employees for a period of five years, i.e. from 01.04.2018 to 31.03.2023. During the subsistence of the contract, disputes arose with regard to the payment. As per the agreement, the petitioner filed an application u/s 11 of the Arbitration & Conciliation Act before this Court.
