1. This summary suit is filed by the Plaintiff under order 37 of

CPC for recovery of an amount of Rs.7,21,000 /- together

with interest @ 18% p.a. on a sum of Rs.7,00,000 /- from the

date of filing of the suit till realisation.

2. The Plaintiff carries on business in the name and style of

Rhythm Jewels. Whereas the Defendant No.1 is a proprietary

concern of which Defendant No.2 is a sole proprietor. It is

the case of the Plaintiff that the Plaintiff had supplied the

goods / jewellery to the Defendants and in consideration

thereof the Defendants issued a cheque in favour of the

Plaintiff dated 08.03.2008 for a sum of Rs.7,00,000 /- . It is

further pleaded by the Plaintiff that the cheque when

presented for encashment to Bank of India it was
