HIGH COURT MALAYA KUALA LUMPUR
YAP TEAK SING – Appellant
Versus
LAI MING CHUN @ LAI POH LIN – Respondent
[Civil Suit No: WA-11ANCvC-58-09/2024]

Petitioner Advocates:Dinesh Nandrajog ,Respondent Advocate: Vishal Kumar

Strict compliance with procedural requirements and full disclosure of material facts are essential in committal proceedings, and failure to meet these standards can render such applications moot.

Headnote:(A) Strata Management Act 2013 - Order 52 Rules of Court 2012 - Committal proceedings - The learned Magistrate set aside the Plaintiff's ex parte leave for a committal proceeding against the 1st Defendant, concluding that the Plaintiff's application was rendered academic due to failure to disclose material facts about rectification of leakage. (Paras 1, 10, 11, 12, 14, 17)

(B) Committal Proceedings - The court emphasized that a complete factual disclosure is essential for fair adjudication and that strict adherence to procedural requirements is necessary in committal proceedings. (Paras 15, 16)

Facts of the case:
The dispute arose from a leakage at the Plaintiff's condominium believed to be caused by the Defendant's property. The Tribunal ordered the Defendant to rectify the issue, but the Plaintiff's committal application was based on the Defendant's alleged non-compliance. (Paras 4, 5, 6)

Findings of Court:
The court upheld the Magistrate's decision to set aside the Plaintiff's application, noting the lack of material disclosure and the resolution of the leakage issue, rendering the committal application redundant. (Paras 11, 12, 18)

Issues: The main issues included whether the Plaintiff disclosed all material facts and the implications of setting aside the leave for committal. (Paras 10, 11)

Ratio Decidendi: The court ruled that failure to disclose critical facts invalidated the committal application, and once leave was set aside, the application became moot. (Paras 17, 18)

Result: Appeals dismissed with costs.

(2) Unless within fourteen days after such leave was granted the notice of application is filed, the leave shall lapse.

(3) Subject to paragraph (4), the notice, accompanied by a copy of the statement and affidavit in support of the application for leave under r 3 and the order granting such leave, must be served personally on the person sought to be committed.

(4) Without prejudice to the powers of the Court or Judge under O 62 r 5, the Court or Judge may dispense with service of the notice under this rule if it or he thinks it just to do so.

[9] The above provision was duly followed by the Plaintiff to serve to the 1st Defendant with the committal notice as stated in the above provision.
