2022 MarsdenLR 2935
HIGH COURT MALAYA KUALA LUMPUR
ABDUL MALEK MOHAMED – Appellant
Versus
MISC BERHAD & ANOR – Respondent
[Judicial Review Application No: WA-25-299-10/2020]
The court determined the employer's right to dismiss for poor performance is valid if due process is followed, emphasizing the importance of employer's assessment credibility.
Headnote:This judgment considers the judicial review of the Industrial Court's award regarding an unfair dismissal. Under the Employment Act, the Applicant challenged a dismissal for poor performance, asserting errors in evaluation by the Industrial Court and claiming unjust treatment. The Court ruled that the Applicant was given adequate opportunities to improve performance under the Performance Improvement Plan (PIP) and found the dismissal justified. The key issues considered were whether the dismissal lacked just cause and the adequacy of the PIP process. The Court upheld the Industrial Court's decision, concluding that the dismissal of the Applicant was made with just cause and excuse.
