[1] The accused, Wong Weng Heng was charged with 2 charges of trafficking in dangerous drugs to wit, 63.9g of 3,4- Methylenedioxymethamphetamine (MDMA) and 203.6g of Methamphetamine under s 39B of the Dangerous Drugs Act 1952 ("the Act") respectively and one charge for possession of 149.7g of Etizolan under s 30(3) of the Poisons Act 1952 ("Act 366").
[2] The charges are as follows:
First Charge
"Bahawa kamu pada 8 Januari 2021 jam lebih kurang 4.30 petang bertempat di kawasan lorong belakang bangunan HSBC Bank, Jalan Metro Perdana 1, Kepong, di dalam daerah Sentul dalam Wilayah Persekutuan Kuala Lumpur telah mengedar dadah berbahaya iaitu 63.9 gram 3,4- Methylenedioxymethamphetamine (MDMA). Oleh yang demikian kamu telah melakukan kesalahan di bawah s 39B(1) (a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah s 39B(2) Akta yang sama."
Second Charge:
"Bahawa kamu pada 8 Januari 2021 jam lebih kurang 4.30 petang bertempat di kawasan lorong belakang bangunan HSBC Bank, Jalan Metro Perdana 7, Kepong, di dalam daerah Sentul dalam Wilayah Persekutuan Kuala Lumpur telah mengedar dadah berbahaya iaitu 203.6gram Methamphetamine. Oleh yang demikian kamu telah melakukan kesalahan di bawah s 39B(1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah s 39B(2) Akta yang sama."
Third Charge
"Bahawa kamu pada 8 Januari 2021 jam lebih kurang 4.30 petang bertempat di kawasan lorong belakang bangunan HSBC Bank, Jalan Metro Perdana 7, Kepong, di dalam daerah Sentul dalam Wilayah Persekutuan Kuala Lumpur telah ada dalam milikan kamu iaitu 149.7 gram Etizolam dan dengan itu kamu telah melakukan kesalahan di bawah s 30(3) Akta Racun dan boleh dihukum di bawah s 30(5) Akta yang sama."
Narrative Of The Prosecution Case
[3] Five (5) witnesses were called to testify to support the prosecution case and they are:
i. Koperai Mohd Nor Fadli bin Mustafa (PW1): Photographer (crime scene)
ii. Madam Chong Lee Ken (PW2): The accused's mother and car owner of Toyota Vios WUU 818
iii. Sjn Mustaza Nizan bin Minhaj (PW3): Photographer (drugs exhibits and fingerprints dusting)
iv. ASP Wan Mohamad Fauzie bin Wan Daud (PW4): Arresting officer
v. Inspector Muhammad Hilmi bin Rosli (PW5): Investigating officer
[4] On 8 January 2021 at approximately 4.30 pm. acting on information received, PW4 and his team dressed in civilian clothing and carrying firearms conducted surveillance for about 30 minutes at Jalan Metro Perdana 7, Kepong, Kuala Lumpur where they saw the accused walking in the lane behind HSBC Bank holding a white and orange paper bag ("the paper bag") (P13).
[5] The accused was then ambushed by PW4 and his team. According to PW4, upon being accosted, the accused had dropped the paper bag and reacted aggressively. The accused was later apprehended.
[6] PW4 inspected the paper bag and found one Guan Yin Wang tea bag (P16) and two brown paper bags ail of which were sealed (P14(a) and P14(b)). These three bags contained the impugned drugs forming the subject matter of the three charges proffered against the accused.
Prosecution's Contention
[7] On behalf of the prosecution, the learned Deputy Public Prosecutor submits that the prosecution has succeeded in proving a prima facie case against the accused on all the charges premised on direct evidence of trafficking under s 2 of the Act and the presumption under s 37(d) of the Act wherein, the accused is said to have had possession and the r
