JUDGMENT
Background Facts
[1] The parties, both in their mid-50s on the date of the trial of this matter, married on the 22 December 1992. This union resulted in four issues, two of whom came to this world before their parents legalised their union. The Husband Respondent left the matrimonial home in February 2018.
[2] The Wife Petitioner ("WP") filed a single petition for divorce, which was resisted by the Husband Respondent ("HR"). On the date this matter came up to be heard in April 2022 the ages of the children were:-
[3] The WP alleged, as grounds for seeking the dissolution of the marriage besides the separation, physical abuse by the HR, threat of murder, extra-marital affair by the HR and neglect.
[4] Although denied in pre-trial affidavits, during the trial of this case, the accusations of the WP were largely unchallenged by the HR. The HR admitted to physical abuse but countered by saying that they were aggravated by the WP.
[5] It became apparent that the HR was contesting this divorce principally contest the WP's right to one half of the assets of the HR as well as the WP seeking monthly maintenance of RM2,500 ostensibly for herself and the welfare
