Introduction

[1] There are two applications for this court's determination:

(i) application by the petitioner husband ("PH" - encl 12) for the transfer of the respondent wife's ("RW") half share in Valencia to PH and overnight access to the children of the marriage; and

(ii) application by RW for Valencia to be sold at a market value of RM2.1m to RM2.4m and other related prayers.

[2] These applications were heard simultaneously on 26 January 2021, and my decisions are as follows:

(i) Enclosure 12: I dismissed PH's application for the transfer of RW's undivided half share in the Valencia House but allowed his application for access to the children of the marriage. Dissatisfied with part of this decision, he has filed an appeal against this court's decision in dismissing his application for the said transfer.

(ii) Enclosure 19: I dismissed part of RW's application but allowed her application for Valencia to be sold off via public auction or otherwise and the costs/proceeds of the auction to be born equally between the parties. Dissatisfied with part of the decision, PH has filed an appeal against this court's decision.
