JUDGMENT

Shahnaz Sulaiman J:

Introduction

[1] The accused was charged under s 302 of the Penal Code for the murder of a man. The prosecution produced 14 witnesses throughout the trial. At the conclusion of the prosecution case, this court found the prosecution had established a prima facie case against the accused. The accused chose to give evidence under oath as SD1. SD2 was the accused's sister Thoshaani A/P Thamil Vanan, SD3 was the accused's stepfather Premen A/L Prabhakaran and Kavitha A/P Panjasarong as SD4 being the accused's mother. At the end of the trial, this court found the accused guilty and convicted the accused on the charge. This is the judgment of this court.

The Charge

[2] The charge proffered against the accused read as follows:

"Bahawa kamu bersama-sama dua lagi yang masih bebas pada 29 Mei 2018 jam lebih kurang 8.30 malam, bertempat di hadapan rumah No 02-19 Blok E, Jalan Teratai 7, Plentong di dalam Daerah Johor Bahru, di dalam Negeri Johor Darul Takzim, telah membunuh Baskaran a/l Subramaniam; KPT: 850821-08-6819. Oleh yang demikian, kamu bersama-sama telah melakukan suatu kesalahan yang boleh dihukum di bawah s 302 Kanun Keseksaan dan dibaca bersama s 34 Akta ya
