[Suit No: WA-22C-11-02/2018]
Important Points
Subject
Civil Law - Stay of Execution
Headnote
(B)
Stay of Execution – Granting a stay of execution is not automatic and must be substantiated with special circumstances – The mere existence of an appeal does not stay execution unless compelling grounds are provided. (Paras 19, 21)
(C)
Financial Management – The court found that the claims of financial distress were common circumstances not warranting a stay – The lack of concrete evidence by the Plaintiff led to the dismissal of its claims for a stay. (Paras 22, 27)
